Claudio- I have reviewed the docket and the pleadings filed in the case so I know what has previously occurred. I have spoken to Bill Matthews, the attorney for the Trustee. He will provide us with the amount of Austin's unsecured deficiency claim so we know what has to be paid. The Trustee, his Atlanta counsel and his Chilean counsel will obviously incur significant fees which the Court will allow to be paid out of the proceeds of the sale of the lots. There has been no decision yet on how to market the lots in Chile but initially at least the Trustee will not auction them off. The Trustee is committed to, and has a duty to, market the properties in a commercially reasonable manner and get the best value for the lots. The offers you provided have been given to the Trustee's attorney in Chile. I recommend we get the amount of claims that will be needed to be paid ie Austin and his partner and the Trustee's attorneys fees and then monitor the Trustee's effort to sell the lots. I'm sure we can arrange for you to speak directly with the Trustee's Chilean counsel in this regard. Attached is an engagement letter for your review and wiring instructions for the retainer.
