August 15 2016 Sent email to creditor, he called back the same day

Aug 17 called Victor Harrison and was told I con't not speak with him, must have an attorney.

Sent email and he called right away
He gave me the impression he thought I converted the case to Chapter 7 again.
He might come to an agreement.
Told him the property is under valued by the court, and will be sold for less than it's potential value.
He told me to talk to Victor Harrison  and come to a resolution.

Dear Jerry and Eddie,

As you know we are enriching the attorneys that are making our situation worse, or maybe more correctly mine.

As you know the mystery of weather or not the subdivision in Chile was a viable asset has been resolved. Although it took time, I have set up a sales group and have properties ready to sell in Chile. This can bring our accounts current in short order. It will permit me to continue payment on my mortgage obligations to you, and normalize my business situation with tenants on Liberty road. You have the ability of letting me bring these moneys to Douglas county. Paying you is a positive for the local economy and our prior agreements.

In Chapter 13 the outcome was a good one where I could sell my properties and pay my obligations to you.

My attorney did not describe these sales nor my intentions. He did not file the proper documentation with the court and now has mysteriously stepped away. He did not communicate with you to arrive at a better outcome.

This is a very complicated case, that may now require an international dimension as the Chapter 7 trustee will attempt to sell the properties in Chile. A very simple situation that would have been resolved without any action by you in Chapter 13 is now becoming a special and very unusual bankruptcy case.

All attorneys I have spoken to lately, have indicated to me that the current Chapter 7 trustee is well known for huge legal fees which will eventually come from the assets we both have.

This is my petition to the both of you..

That you take a more reasonable path, that we come to an agreement that will midigate legal fees and permit me to sell the properties in Chile making our mortgages current.

Your good will and assistance could avoid further costs, and normalize this situation to what we had agreed to in the first place.

I know both of you to be longtime and integral members of the Douglas county economy.

I ask that you take this more reasonable path, let me continue in business, and permit me to be an asset to the community you both belong to.

This is my application to you as such.

Sincerely,

Claudio Avendano
