Bankruptcy corruption articles
I send this email to you so that you may be aware of a particular bankruptcy case, and political events that point to issues you may help to correct.
Having run out of options, I am now looking for solutions via crowdsourcing, maybe you could assist by sending this information to others.
What seems obvious is that when any debtor who comes to bankruptcy court to pay his obligations he should be is permitted to do so.
The incentive to deplete the assets of both the creditors and the debtor by the Chapter 7 for personal gain, must be taken out of this law. The Chapter 7 Trustee must be salaried government position. There should be an ability to recover punitive damages from a Trustee and his law firm, when they are acting against the best interest of the estate.
I love to talk about the importance of democracy and justice. In order to set the stage, I think it is necessary to start with local political activities, that led to the associated bankruptcy.
These events made me conclude that the only political problem there is, is corruption. People that are in the habit of taking things that do not belong to them. I think that politics and the courts are the ideal tools for these people to take what does not belong to them.
There is too much potential for abuse by Trustees in bankruptcy cases. There are many legal incentives for Trustees to misbehave with the estates they are entrusted with.
Without fundamental changes and strong supervision, abuse problems will always arise. To have those that are given the charge of "trust" over an estate, or a court that is titled “protection” to become a trap for those who are desperate, and in need of assistance is simply not right.
There is a history of problems with Trustees. http://metroecho.com/Bankruptcy-Articles
These issues are above the scope of my case, yet the previous failure to attend to them by those able to do so is the cause of the problems I now face.
I have presented this story the best I can, and hopefully in a readable fashion. Most of this is available as court documentation.
I hope you will you will consider this account, look for ways to assist in fixing these issues and make others aware so that changes to this law will come about.
Please contact me with suggestions and your Congresspersons, Senators, and the Office of the Trustee to correct this problem with the bankruptcy law.
